Yet it happened in New Orleans in the aftermath of Katrina. Guns were forcably removed from people. I would hope the branches of the military can get together and declare they will not obey such an order.

The people doing the confiscations were thugs and bullies. Marines have Honor and took oaths to protect this nation against all enemies... foreign... and domestic.

If someone isn't removed from the office he now illegally holds, I believe a command will be given to confiscate our firearms. It could be gradual, such as the Assault Weapons Ban that has been proposed and which Eric Holder wants. Then it will be illegal searches and seizures, then they'll come for us in the middle of the night. If one step is taken and accomplished, more will follow.

As a non-military person, I cannot express how moved I am by this site and by the military's dedication to this country. You are the true patriots, the defenders of our freedom. We the American people cannot do it without you. We are in a fight for the soul and survival of this Republic, and you who wear or did wear the uniform know exactly what is at stake. Thank you all, from the bottom of my heart.

As somebody already mentioned, it happened in Katina,it can happen again. This poor Marine sergeant is either lying,which I doubt, or diluted. Yes they will try,but it would be a helluva fight.

I would have asked the Marine if in the event of Martial Law being declared and the Constitution suspended would he consider an order to disarm the people as a legal directive?

In my non-military opinion, I would say that since no one is above the law (the Constitution being the supreme law of the land) and that includes the president, Congress and any other governmental agency, a direct order during declared martial law is still illegal. In fact, from what I've read, the Constitution doesn't grant the president executive order privilege anyway and he sure can't use them to usurp the Constitution. I don't think the Framers meant to establish a dictator by some guy trumping up some crisis, then declaring the established laws of the land null and void.

You're a lawyer, right? It's my understanding that neither Congress nor the president can alter, abridge or repeal the Constitution in any way. The only way a change can be made is by a bill passing both the House and the Senate, then going to the states for 3/4 ratification. Can you explain the legalities of martial law and executive orders? Well, if you don't mind, would you explain anything I may have misinterpreted? Thanks.

The Marine Public Affairs Officer never answered the question. Would HE obey orders to confiscate weapons? He only said he didn't see it happening, and hoped it wouldn't happen during his lifetime. Having taken an Oath to support and defend the Constitution, he should have been able to state that he would NEVER violate his Oath. Sadly, he came off sounding like a politician, rather than a Marine.

Granted, he was put in the difficult position of having to reveal his personal opinion, and subject himself to possible retaliation by his superiors. The fact that he was so evasive illustrates that fear of retaliation exists.

See, that's what worries me. Nobody is coming out and flat out making a declaration that any order that is illegal, contravenes the Constitution, or is detrimental to the safety, and security of the American people will be ignored and the people issuing the orders will be arrested.

That's right, or by a new constitutional convention.

Nor does the Constitution establish an elected dictatorship, contrary to the assertions of some fake conservatives, such as John Yoo.

As Madison said in the Federalist papers:

"The accumulation of all powers, legislative, executive, and judiciary, in the same hands ... may justly be pronounced the very definition of tyranny." - James Madison, Federalist No. 47"

And as Madison also pointed out, if men were angels, there would be no need of government, and thus, we cannot count on wise and virtuous men being at the helm. That is why the Constitution limits and divided power, and that is why we also have a Bill of Rights to serve as a further check.

All the assertions of the executive supremacist crowd fly directly in the face of the wisdom and intent of the Founders - such views are far more in line with the thinking of Marx, Lenin, Stalin, and Hitler - that the state is omnipotent, and the individual is nothing.

About the marine PAO Responding to Gun Confiscation Question: I think he's a coward. When are these guys going to just say "Hell No" to the questions posed to him? If the orders violate the constitution and turn against american's rights then the military should take a bold stand and say Hell No!

But that's just one man's opinion.

Sorry to say I agree with others here who opine that this Marine PAO would obey orders to confiscate guns, or any other illegal order he was given. I do believe he showed his fear of retalitation to be greater than his fear of loss of honor.

Thank you, Stewart, for the reply regarding the executive branch establishing a dictatorship.

I pray our military will continue to discuss this issue and educate their fellow soldiers who aren't as well versed in the limitations the Constitution places on the federal government.

I'm grateful for all of you, our past and present defenders of freedom. May God hold you in His hand, keep watch over your families and grant His merciful protection to this nation.

The Constitution was written as a negative disposition against American Government, in that the Constitution restricts what American government can and cannot do to sustain individual liberty and limited power within government. Therefore, any time that the government amends or seeks to change the constitution, it must be consistent with the negative intention that keeps government in limited power and size. When government seeks to change or amend the constitution whereby the end result is that American Government is more powerful, intrusive within individual liberty or larger, that in and of itself violates the negative nature of the constitution, thus whatever legislation follows from that reverse intention become null and void. In the same respect, if the Constitution defines what and how American government will operate and said government chooses not to abide by those restrictions, then it is no longer American government, but has become a foreign foe. This then comes down to the fault of those people within government, to those who do not abide by their oath of office, but seek to make a name for them self within the context of service (oxymoron) or to create a new government entirely. How do we stop this disease within our American government?
